Terms of Service

By accessing or using Orbit ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

Orbit is an AI-native development environment that combines a code editor, AI agent, embedded browser, terminal, and documentation vault into a single native desktop application. The Service is provided by Recursive Labs ("we", "us", or "our") and is currently available through our early access program.

To access certain features of the Service, you must sign in with a Claude account or provide your own Anthropic API key. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not: • Use the Service in any way that violates applicable laws or regulations • Attempt to gain unauthorized access to any portion of the Service • Use the Service to transmit malware, viruses, or other malicious code • Interfere with or disrupt the integrity or performance of the Service • Use the Service to generate, store, or transmit content that infringes intellectual property rights • Reverse engineer, decompile, or disassemble any portion of the Service • Use automated systems or software to extract data from the Service without permission

The Service and its original content, features, and functionality are owned by Recursive Labs and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Your code and projects remain your property. We claim no ownership over the content you create using the Service.

The Service integrates with Anthropic's Claude API. Your use of AI features is subject to Anthropic's terms of service and privacy policy. We are not responsible for the content generated by AI models or any actions taken based on AI suggestions. When you use AI features, relevant portions of your code and context are sent to Anthropic's API. You acknowledge and consent to this data transmission as necessary for the AI features to function.

The Service is currently provided as an early access version. Features may be unstable, incomplete, or subject to change without notice. We make no guarantees regarding the availability, reliability, or performance of early access features. Your feedback during this period helps us improve the Service.

Certain features of the Service may require a paid subscription in the future. By subscribing, you agree to pay all applicable fees. We reserve the right to change pricing with reasonable notice. During early access, the Service is free.

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately. You may terminate your account at any time by contacting us. Provisions that by their nature should survive termination shall survive.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RECURSIVE LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

You agree to indemnify and hold harmless Recursive Labs and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Recursive Labs is incorporated, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration.
